Judge Sumi…Partisan Hack?

Dane County Judge Maryann Sumi, as expected has finally ruled against Wisconsin’s passage of the Collective Bargaining Law.  Judge Sumi said legislators violated Wisconsin’s Open Meetings Law.  Sumi could have heard this case promptly but chose to sit on it for a couple months.  I believe this was by design.  She wanted to stall for as much time as possible for Democrats and Unions to organize as much opposition as possible.  Delay would also make it possible for senatorial recalls to gain steam and maybe even take place before the law could be heard by the Wisconsin State Supreme Court.  The recall elections could tilt the state senate back to Democrats, thus thwarting the passage of the bill should it end up back in the legislature.  Judge Sumi was also aware that her decision against the bill would certainly be appealed all the way to the states High Court.  With Supreme Court Justice Prosser up for re-election and facing a well known liberal state attorney, it’s my belief that Judge Sumi was actually hoping for his defeat.  That would mean the balance of the court would tilt left and her ruling would probably not be overturned.  Result?  Big win for Dems and Unions.  Huge loss for Wisconsin’s taxpayers.

Judge Sumi should have recused herself from this case.  Her son, Jake Sinderbrand,  has “served as a lead field manager with the AFL-CIO and as data manager for the SEIU State Council through the 2008 election cycle.”

Jakey also runs a company called Left Field Strategies” that’s basically a public relations firm for politicians or companies attempting to make as much contact with the public as possible during campaigns.  Jakey is the guy who gets those people to call you and knock on your door at the most annoying times.  On Jakey’s facebook page when all this stuff broke,  he had a picture of Governor Walker with the word “DOPE” below it.  He also had these words on his page as well next to the picture of Governor Walker:  “RIP middle class–Wisconsin has officially become the Tea Party’s laboratory for plutocracy. We learned today that Judge Sumi made her decision the day after being notified by the Wisconsin Department of Justice that they were considering having the Supreme Court force her to recuse herself.  I guess she thought she had better get on it before it was too late.  More about it here:  http://www.620wtmj.com/blogs/charliesykes/122682209.html

Under Wisconsin’s Code of Judicial Conduct, “a judge may not be swayed by partisan interests, public clamor or fear of criticism.” Also, “a judge may not allow family, social, political or other relationships to influence the judge’s judicial conduct or judgment.”

Update:  5/27/11
The Wisconsin Department of Justice has now asked the State Supreme Court to vacate Judge Sumi’s ruling.  The Milwaukee Journal Sentinal has the story.  Here is the link.

  1. Judge Sumi (what an appropriate name for a judge)is way off base ruling that open meeting law was violated.The Democrats walked out!They should be fined for not representing their constituents properly.
